Abbott Senior Legal Counsel in Rome, Italy


This lawyer’s primary role will be to provide legal advice and direction to all divisions based in Italy, including diagnostics, nutrition and medical devices. He/she will be based in Rome alongside the business divisions and will report to the Legal Head of Italy.


Individual to provide timely commercial legal advice and support to Abbott’s businesses based in Italy. Duties will include analysis and provision of legal advice focused on business-oriented solutions on a wide range of matters, including general commercial, public procurement, distribution and agency agreements, medical device/nutritional law compliance, litigation, marketing and promotion initiatives, corporate governance, data protection law, compliance with Law 231/2001 on Corporate Criminal Liability and antitrust.

Role will include conducting education, singly or in conjunction with OEC, for business teams on legal-related issues including but not limited to anti-bribery and corruption, Abbott’s Third Party Process, Law 231/2001 and public procurement.

Supervisory/Management Responsibilities

  • Responsibility for legal services within assigned client areas.

  • Helps Legal Head of Italy develop Legal Department's strategy based on country inputs and counsel.

  • Mentors, supports and directs support staff; serves as a role model and as a champion of the legal department through work ethic, attitude, interpersonal skills and successful results.

  • Reports to the Legal Head of Italy.

  • Is well versed in ‘navigating the grey’ as regards legislative gaps/anomalies and displays excellent risk assessment skills.

  • Negotiates independently or with senior attorneys on significant matters and areas of importance to management.

  • Expected to acquire after joining a solid knowledge of Abbott businesses supported and knowledge of the broader business impact.

  • Resolves routine and moderately complex to complex legal matters day to day in practice area with minimal supervision from more senior attorneys.

  • Keeps abreast of changes in laws that affect client areas; communicates these to business; and represents Abbott externally to customers, suppliers, competitors or government agencies.

  • Resolves legal issues using negotiation skills and legal expertise; coaches and directs assigned support staff (may include paralegals) in their responsibilities

  • To the extent that complex problems or specific technical expertise is required, helps to select and direct the work of external counsel, defines project objectives, manages costs and manages project in line with business expectations.

Position Accountability/Scope

  • Advises Legal Head of Italy or other legal departments of critical project developments /matters in a timely manner.

  • Assigned matters may have a moderate to significant impact on business activities and operations.

  • Advises Country Managers and General Managers across Italy. Must operate within appropriate budget(s). Develops budgets for assigned legal matters where necessary.

Personal Aptitude

Candidates must be self-starters capable of taking the initiative to drive matters/projects through to a successful conclusion. Solid negotiating and persuasive skills coupled with excellent inter-personal and communicative skills will ensure that complex legal concepts are able to be couched to the business at the right level. Candidates will have a strong background in in-house legal practice thereby recognizing the need to work from an embedded commercial perspective as opposed to a legal silo. Whilst self-reliant, candidates will nonetheless be able to work as value adding, specialist contributors on cross-functional project teams. Candidates will be expected to quickly familiarize themselves with the business models and strategies of each business division and to build solid working relationships with business leaders and Abbott’s OEC, IFO, GA and HR functions.

Professional Qualifications and Work Experience

A qualified lawyer (with admission to Italian Bar ) with 7+ years of experience as in-house counsel of multinational companies, the majority of which will have been spent for a medical device/pharmaceutical/healthcare company.

In particular, candidates must have experience in:

  • Drafting and negotiating commercial contracts (including but not limited to distribution agreements, agency agreements, provision of services agreements, confidentiality agreements);

  • Medical devices or other healthcare product sector experience;

  • Public procurement law advice and litigation;

  • Anti-bribery and corruption matters, including compliance programs under Law 231/2001 matters;

  • Anti-Trust/Competition law matters;

  • Commercial litigation matters.

Preference will be given to candidates who, in addition to the above, can demonstrate experience in:

  • Data Protection/Privacy law matters;

  • Corporate governance, especially for extraordinary company restructuring (mergers, demergers and business rent);

  • Government investigations;

  • Consumer law matters.
